Trust and privacy are at the top of TalentSky's list of core values. We feel that users should be the stewards of their own data and control the extent to which they share information. However, information privacy and security are shared responsibilities. Certain information you post to the TalentSky community may be viewed, used, and retained by other users, as described in detail below. It is your responsibility to limit the information you provide, and to use the Services in a way that preserves your privacy and security. Please read this policy carefully to understand how your information is shared and other choices you have regarding your information.
If you are accessing the Services through an account linked to, created, or maintained by your employer or enterprise, your enterprise may control which features and information are available to you, and may be able to monitor or access information related to your use of enterprise features. For example, your employer or enterprise may have the ability to view your administrator or enterprise (non-individual) level account usage and view information or analytics that are not available to individual-level users. Your employer or enterprise reserves the right to terminate your access to and use of the enterprise portion of your account. We are not responsible for actions of your enterprise with respect to your account or your information. See our Terms of Service or your enterprise agreement for more information and any additional terms relating to the rights and obligations of employers and TalentSky with regard to enterprise accounts.
DATA WE COLLECT & HOW WE USE IT
When you visit our Websites, register, or otherwise use the Services, we may collect information that, either alone or in combination with other information, can be used to identify you individually ("Personal Data"). Personal Data and any other information we collect from you, regardless whether it can be used to identify you, is collectively referred to as "user data."
We typically use your User Data for the following purposes: (i) to provide, administer, and improve the Services (e.g., adding new skills and job titles, or analyzing trends in User Data); (ii) to personalize the Services (e.g., to suggest new skills or provide you with personal metrics derived from your User Data); (iii) to enable the features of the Services (e.g., creating and displaying your skills and timeline); (iv) to communicate with you; (v) consistent with any consent you provide; or (vi) any other uses reasonably consistent with the context in which such information was disclosed.
We typically collect User Data as follows:
When you Register as a User: When you register for our Services, we collect Personal Data from you, including your name, email address, employer, job title, and any additional Personal Data and other User Data you choose to add when registering to use the Services or requesting information. You must create a user name and password in order to access the Services. As discussed in detail below, some of your registration information may be public and you consent to any publication by providing such information. Do not provide this information or register for the Services if you do not wish for this information to be made public.
When you Create or Edit your Profile: We collect information from you when you choose to store, upload or share additional information and content related to your employment and skills. You may provide such information when you use certain profile features or add content, such as moments, skills, work experience, education, graphics, videos, messaging, comments or similar content.
When you Access our Websites and Services: When you use our Services or access our Websites, we may collect your IP address, operating system information, web browser and version number, internet provider, and other information about your connection to the internet. We may also collect aggregated User Data regarding your use of the Services, such as the number of visitors to the Websites, and other frequency and patterns of use, tag usage, and usage trends ("Aggregated Data"). We may collect this type of information to analyze overall trends to help us improve the Services, help us understand usage of the Services, and to track aggregate data about our user base.
Information We Create: We also collect or derive some information which can be correlated with, or derived from, User Data (such as a user's skill "score" and relative skills rating or ranking, their gender, age, location, certain usage data, and general skills data, etc.). We use this information to provide, or improve the provision of, Services to you, monitor and analyze use of the Services, for technical administration of the Services, to increase the Services' functionality and user-friendliness, and to provide analytics regarding user skills, employment patterns, labor market dynamics, and other information to enterprises, including regarding their enterprise users. We may also use this information to analyze the connections between users, suggest users whom you may know, and use certain skills information to augment our skills and job title database, or for other features of our Services.
HOW WE SHARE USER DATA
We will share your User Data with other users only in accordance with the applicable account preferences set by you when you use the Services, or as otherwise set forth below.
Information Available to the Public: User data such as your name, place of work, and job title may be available to the public, regardless of your choices. If you choose to make additional profile information public, you may do so through the Settings menu. Except for the limited public profile information above, you may control whether other users, your co-workers, or the public may view your information. See below for more information regarding your choices regarding the sharing of your User Data.
Information Shared with Your Employer / Enterprise: If you are an enterprise user, certain User Data may also be shared with your enterprise and/or users in your enterprise, regardless of your choices. For example, your enterprise and its enterprise users may have the ability to view your account usage, track your skills, and access additional User Data (such as, moments, timelines, skills, followers, and colleagues.)
Information Shared with Other Users: The Services allow you to post, upload, and share Personal Data, content, and other information in different ways, and such posting and sharing may personally identify you as the source. In addition to posted information, the Service may display some basic information such as your name, photo, company, skills, and job title to other users. Except for the public profile information described above, any User Data you post or share will be available to other users of the Services (for example, without limitation, people that follow you on the Services) in accordance with your account preferences, and we cannot control how it is collected, used, reproduced, and/or disclosed by such other users. If you follow or are a colleague of a user or enterprise, other users may be able to see your name on lists of followers or colleagues. If you share your skills and moments, you may appear in searches or otherwise to users who have or seek similar skills, or if they search for or are related to a particular moment.
Messaging: Our Services allow you to message individual users. By default, you are available for messaging by other registered users. By messaging a user, you consent to the sharing with that user of your name, job title, and employer, as well as any other Personal Data and information you disclose in your message. Do not disclose information in messages to users if you do not wish this information to be shared accordingly. You may control which users may message you and the information visible to other users by changing your preferences through your account settings menu. Enterprise users' messages may be visible to administrators of that enterprise.
Legal Disclosures: We may release your User Data or other information you have posted on the Services when necessary or appropriate to comply with the law, cooperate with law enforcement or national security requirements, respond to lawful requests, enforce our Terms of Service, or protect the rights of TalentSky, other TalentSky users or enterprises, and third parties. However, in doing so, we may: (i) dispute demands for release to the extent we believe — in our sole discretion — are unwarranted, illegitimate, or overly broad; and (ii) when appropriate and permitted, we will notify you of any requests for release.
It is possible for you to visit our Websites without providing Personal Data, but you may not be able to use or register for our Services, or access certain features and content. Through your account settings menu or choices provided to you when you post user data, you may change your preferences regarding sharing moments, your profile and other elements of your User Data with other users or the public. We strive to respect your choices with regard to sharing of User Data with other users, however, we cannot guarantee that all User Data and Personal Data you share will remain visible to only a certain class of users.
To the extent required by law, you may choose to opt out of sharing with any other parties with whom we may share your Personal Data; however, you may be unable to use the Service or certain features if you wish to limit such sharing. Further, you may, to the extent you expressly consent to our sharing of your Personal Data with others, opt out of having your information provided to third parties for marketing or other commercial purposes, and opt out of additional communications from us. You can unsubscribe from all email newsletters or similar communications by clicking on the unsubscribe link in every email. You may opt out of all information sharing with third parties for marketing purposes (if any) by contacting us at the address or email below.
ACCESSING, CORRECTING, AND DELETING YOUR INFORMATION
You may access, update, change, or delete your User Data. In some cases, we may retain copies of the original information, to the extent required by law, to protect TalentSky's rights, or if it is not reasonably technically feasible to remove it. To update your user profile or delete User Data, please login to your account and visit your Settings page.
Accounts may be deactivated upon your request on your Your Account page, or in some cases, may be deactivated or suspended by us. In such instances, we may retain all of your User Data and other data we have for thirty (30) days during which time you may be able to reactivate your account (unless deactivated or suspended by TalentSky) and recover and reload all of your User Data. If an account remains deactivated for more than thirty (30) days, TalentSky will delete all profile, timeline, and moment data from its active servers, except for the user name and associated email addresses; provided that we may retain certain information if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements. Notwithstanding the foregoing, TalentSky may retain (a) feedback/verification you have given to other TalentSky users, and the identity associated with feedback (such as your name and email addresses), (b) skills you have submitted to the skills library, c) organizations you have submitted to the organizations library; and d) User Data as used for general statistical analysis.
Please note that retention of your User Data may be governed by the policies of another organization, enterprise, or entity of which you are a member. Please review those policies before using the Services and contact those organizations in the event you wish to access, correct, or delete your Personal Information.
California residents may request and obtain from us a list of what Personal Data (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. You may make one request each year by contacting us as set forth below.
We have implemented reasonable security measures to safeguard the Personal Data you provide us. However, please keep in mind that we cannot be liable for the actions of third parties to whom we may transfer your Personal Data in accordance with this Policy, or third parties to whom you directly provide your Personal Data (such as purchasing goods or services from a third party through links on our Services). Furthermore, please remember that "perfect security" does not exist on the Internet, and accordingly we cannot provide any guarantee that your Personal Data or any other information you provide us will remain secure.
USERS UNDER THE AGE OF 13
Our Services are not directed at people under 13. If you believe that your child has provided us with Personal Data without your consent, please contact us at firstname.lastname@example.org. We do not knowingly collect Personal Data from children under 13. If we become aware that a child under 13 has provided us with Personal Data, we take steps to remove such information and terminate the child's account.
LIMITATION OF LIABILITY
By providing us with any Personal Data you expressly and unconditionally release and hold harmless TalentSky, its parents, subsidiaries, affiliates, related companies, and their respective shareholders, owners, members, directors, officers, employees, and agents (collectively, the "Releasees") from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the use and/or misuse of your collected Personal Data. In addition, we cannot be held liable for any injuries, loss or damage of any kind arising from or in connection with the use and/or misuse of your Personal Data by any third parties who receive your Personal Data. We make no representations or warranty regarding any third-party's use, collection, or disclosure of your Personal Data.
